Personal Injury
Process
Our service is designed to provide you and your clients with expert financial advice and support at every stage of the claims process - or at such stages as you choose. Every case is individual and we can tailor the service provided to meet the specific requirements of the client. Some examples are:
Working with the Court of Protection
We are experienced at dealing with clients of the Court of Protection and Deputies/Receivers and the implications of the Mental Capacity Act on them.
Periodical Payments
We can produce a fully independent periodical payment feasibility report, execute the implementation where appropriate and after settlement provide investment advice on capital not committed to the periodical payment, or on the full amount of capital awarded should the periodic payment option not be appropriate.
Trusts
Clients who have been awarded compensation are often worried by the responsibility of dealing with such a large sum of money. Equally, they may be in receipt of means-tested benefits, which in turn, could be jeopardised. In order to protect these benefits, their award may be settled into a trust under the Income Support Regulations Act 1987. We will liaise with appropriate trust lawyers in this respect.
Our process and services
The diagram alongside sets out the principal elements of our services to legal professionals and their clients. Legal advisers and their clients may wish to use our full process for comprehensive involvement throughout the case; or any part of it, for a more specific brief.
